Terms of Service
Welcome to Life Chart Museum. These Terms of Service (“Terms”) govern your access to and use of the Life Chart Museum mobile application, website, public profile pages, and related services (collectively, the “Service”). By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your country or region, to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.
You must not use the Service if you are prohibited from using it under applicable law or if your account has previously been suspended or banned and we have not authorized your return.
2. About the Service
Life Chart Museum is a profile and timeline-based storytelling service that allows users to create profiles, portraits, biographies, life charts, chart points, classes, tags, and public-facing profile pages. The Service is intended for personal expression, profile creation, browsing, collecting, and sharing.
Certain features may be available for free, while other features, capacities, limits, or visual options may require a paid subscription or another paid entitlement.
The Service is not a medical, psychological, legal, financial, employment, educational, or other professional advice service. You should not rely on the Service as the sole basis for important decisions.
3. Accounts and Sign-In
Some parts of the Service require an account or sign-in method. You are responsible for maintaining access to your account, device, and sign-in method. You are also responsible for activity that occurs under your account.
You must provide accurate information where required and must not impersonate another person or entity, falsely suggest affiliation or endorsement, or use another person’s account without permission.
We may refuse access to, suspend, restrict, or terminate accounts that violate these Terms, harm the Service, create risk for other users or third parties, or are used for abuse, fraud, security attacks, impersonation, or unlawful activity.
4. Account Deletion
If the Service allows account creation, you may request deletion of your account through the in-app account deletion feature or through the support contact made available by us. Account deletion may remove, disable, or make unavailable your account, profiles, charts, images, public pages, favorites, and related User Content from active areas of the Service.
Some information may be retained where reasonably necessary for legal, security, fraud-prevention, accounting, backup, compliance, dispute-resolution, or legitimate operational purposes.
Account deletion does not automatically cancel any active subscription managed through the App Store or another platform provider. You are responsible for managing or canceling your subscription through the applicable platform account.
5. User Content
The Service allows you to create, upload, publish, display, save, and manage content, including display names, handles, profile text, biographies, chart titles, chart points, tags, classes, images, portraits, favorites, and related materials (“User Content”).
You are solely responsible for your User Content and for your use of the Service. You are responsible for ensuring that your User Content is lawful, appropriate for the Service, and compliant with these Terms.
You must only submit, upload, publish, or share User Content that you have the legal right to use. You must not submit User Content that infringes or violates the copyright, trademark, privacy, publicity, image rights, contractual rights, or other rights of any person or entity.
6. Public Profiles, Visibility, and Personal Information
Life Chart Museum is designed for creating and sharing profile-style content, life charts, biographies, images, tags, and related materials. You should only submit, upload, publish, or make available content that you are comfortable sharing with other users or making publicly accessible.
The Service may allow you to set certain profiles or content as public, unlisted, or private. Public content may be accessible through public pages, search, browsing features, sharing features, or other Service areas. Unlisted content may not appear in ordinary search or browsing areas, but people with the relevant link may be able to view it. Unlisted content is not the same as private content.
Private content is generally not intended to be visible to other users, but we may access, process, review, or retain it where reasonably necessary to operate, secure, maintain, troubleshoot, moderate, or improve the Service, comply with law, enforce these Terms, or respond to support, safety, security, or legal issues.
You must not submit or publish highly sensitive, confidential, or unnecessary personal information through the Service, including but not limited to home addresses, phone numbers, private email addresses, government identification numbers, financial information, passwords, authentication credentials, health information, information about minors, or personal information about another person without appropriate permission.
If you make content public or unlisted, that content may be viewed, shared, saved, indexed, cached, screenshotted, or otherwise retained by other users, search engines, browsers, or third-party services. We do not guarantee that public or unlisted content can be fully removed from all third-party locations once it has been made available.
7. Ownership of User Content and License to Us
You retain any rights you may have in your User Content. We do not claim ownership of your User Content.
By submitting, uploading, publishing, or otherwise making User Content available through the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, display, format, adapt for technical purposes, transmit, distribute, cache, create thumbnails or previews of, moderate, and otherwise use your User Content solely as necessary to operate, provide, maintain, secure, improve, promote, and moderate the Service.
This license ends when your User Content is deleted from the Service, except that copies may remain for a reasonable period in backups, logs, caches, security records, legal records, or where continued retention is necessary for legitimate business, safety, legal, compliance, or dispute-resolution purposes.
8. Favorites, Biographies, and Public Interactions
The Service may allow users to save, favorite, collect, organize, or display public profiles or other public content as biographies, collections, or similar records. These features are provided for personal organization, discovery, and expression within the Service.
Saving, favoriting, collecting, or displaying another user’s content through Service features does not transfer ownership of that content, does not create an endorsement, affiliation, sponsorship, or approval relationship, and does not grant permission to copy, republish, sell, or otherwise exploit another user’s content outside the Service.
If the original content is deleted, made private, restricted, hidden, or removed due to moderation or account enforcement, related favorites, biographies, previews, saved references, or public displays may also become unavailable or limited.
9. Community Rules and Prohibited Content
You agree not to submit, upload, publish, display, save, share, or otherwise use the Service in connection with content that:
- is unlawful, fraudulent, deceptive, or misleading;
- infringes copyright, trademark, privacy, publicity, image rights, or other rights of another person or entity;
- impersonates another person or falsely suggests affiliation, endorsement, sponsorship, or identity;
- contains threats, harassment, stalking, bullying, hate, abuse, exploitation, or content encouraging harm;
- contains sexual exploitation, abuse, or inappropriate content involving minors;
- contains highly sensitive personal information, confidential information, or personal information about another person without appropriate permission;
- contains malware, malicious code, phishing, credential collection, or technical interference;
- is used for spam, manipulation, scraping, unauthorized automation, or abusive mass activity;
- promotes self-harm, violence, illegal acts, or dangerous conduct;
- violates applicable law, platform rules, community standards, or these Terms.
10. Prohibited Conduct
You may not:
- use the Service for any unlawful, harmful, or abusive purpose;
- harass, abuse, stalk, threaten, exploit, or unduly influence others through the Service;
- attempt to gain unauthorized access to accounts, systems, networks, source code, data, or non-public areas of the Service;
- reverse engineer, decompile, disassemble, or extract source code except where permitted by applicable law;
- use bots, scrapers, scripts, crawlers, or automated tools to misuse the Service without authorization;
- bypass or attempt to bypass usage limits, subscription limits, access controls, security measures, moderation actions, account restrictions, suspensions, or bans;
- interfere with, disrupt, damage, overload, or impair the Service, our infrastructure, or other users’ use of the Service;
- copy, modify, distribute, sell, lease, sublicense, or exploit any part of the Service except as permitted by these Terms.
11. Reporting, Blocking, Moderation, and Enforcement
We may provide tools to report content, users, profiles, or behavior that may violate these Terms, applicable law, or our community standards. We may also provide tools to block, hide, mute, or otherwise limit interaction with certain users or content where available.
We reserve the right, but do not assume the obligation, to review, investigate, remove, hide, restrict, disable, or refuse to display any User Content or account activity where we reasonably believe that doing so is necessary to enforce these Terms, comply with law, protect users, protect third-party rights, prevent abuse, address impersonation, respond to copyright or privacy complaints, preserve security, or maintain the integrity of the Service.
We may use automated systems, manual review, user reports, technical signals, or other reasonable methods to detect or address violations. We do not guarantee that all harmful, unlawful, inaccurate, offensive, or objectionable content will be detected or removed.
12. Suspensions, Bans, and Circumvention
We may suspend, restrict, or permanently ban accounts for serious or repeated violations of these Terms, abuse, fraud, impersonation, security risks, legal risks, or conduct that harms other users, third parties, or the Service.
We may also limit public visibility, hide profiles, remove content, disable features, restrict creation or editing, restrict access to free or paid features, or take other appropriate action without prior notice where we believe immediate action is necessary.
You must not attempt to bypass moderation actions, account restrictions, feature limits, suspensions, bans, or security measures, including by creating or using additional accounts, using another person’s account, changing identifiers, or otherwise evading enforcement.
We may retain records reasonably necessary to investigate violations, enforce these Terms, protect the Service, comply with law, prevent repeat abuse, or resolve disputes.
13. Copyright and Intellectual Property
All rights in the Service itself, excluding User Content, including software, design, branding, text, graphics, icons, service materials, user interface elements, and other materials provided by us, are owned by us or our licensors and are protected by applicable copyright, trademark, and other laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
If you believe content on the Service infringes your copyright, trademark, privacy, publicity, or other rights, you may contact us through the support contact made available through the Service or store listing. We may request information reasonably necessary to review and respond to your claim.
14. Paid Plans and Subscriptions
Some features, capacities, visibility options, usage limits, or visual options may depend on your subscription plan or other paid entitlement. Paid subscriptions are processed through Apple and the App Store, or through another platform provider where applicable.
Pricing, billing periods, renewals, upgrades, downgrades, cancellations, taxes, payment methods, and refunds are managed through the applicable platform provider’s systems and may be subject to that provider’s own terms, policies, and procedures.
Your access to paid features depends on valid subscription status as recognized by the Service and its billing integrations. Subscription recognition may depend on your platform account, transaction status, region, device, network availability, platform systems, and billing integrations.
We may offer free trials, introductory pricing, promotional pricing, or limited-time subscription offers where supported by the applicable platform provider. Eligibility, duration, renewal behavior, and post-trial billing are determined by the applicable platform provider and the relevant store configuration.
15. Subscription Management, Cancellation, Restoration, and Refunds
You may be able to upgrade, downgrade, manage, or cancel your subscription through the App Store subscription management interface or through the applicable platform provider’s subscription management tools. Cancellation generally stops future renewal but does not guarantee retroactive refunds unless required by applicable law or platform policy.
Any in-app “Restore,” “Restore Purchases,” or similar feature is intended to restore recognized purchase or subscription status where available, but final billing and subscription management remain subject to the applicable platform provider’s systems.
Unless otherwise required by applicable law or the applicable platform provider’s policy, purchases are final and non-refundable. Refund requests must be made directly through the applicable platform provider and are handled under that provider’s refund rules.
We are not responsible for delays, failures, mismatches, or loss of access caused by platform account differences, store availability, billing system errors, network issues, unsupported regions, device limitations, or external billing systems.
16. Subscription Changes, Downgrades, Restrictions, and Bans
If your subscription expires, is canceled, is refunded, is downgraded, cannot be verified, or otherwise becomes inactive, your access to paid features may be limited, suspended, or reduced.
If your subscription changes to a plan with lower usage limits, certain creation, editing, publishing, visibility, storage, favorite, biography, or profile features may become limited until your account usage is reduced to the limits of the new plan. We do not guarantee that content exceeding the new plan limits will remain fully editable, publishable, or visible without adjustment.
If your account is suspended, restricted, or banned due to a violation of these Terms, your ability to use free or paid features may be limited or disabled. Such action does not necessarily cancel your subscription through Apple or any other platform provider. You are responsible for managing cancellation through the applicable platform.
17. Advertising and Promotional Content
The Service may display third-party advertisements, house ads, promotional banners, links, or other promotional content provided by us or by third parties.
Your interactions with advertisements, websites, products, services, app store pages, or other third-party destinations are solely between you and the relevant third party. We are not responsible for loss or damage arising from those interactions.
We do not control every advertisement shown by third-party advertising partners. Advertising availability, targeting, frequency, format, and content may depend on third-party services, device settings, region, app version, and applicable law.
18. Experimental, Test, and Beta Features
From time to time, we may make experimental, test, beta, preview, or limited-release features available. Such features may be incomplete, unstable, unavailable in some regions or accounts, changed without notice, discontinued, or removed.
Data, settings, results, or content associated with experimental features may be reset, deleted, or made unavailable. You should not rely on experimental features for important, permanent, legal, financial, health, business, or mission-critical purposes.
We do not guarantee that experimental features will become generally available or remain part of the Service.
19. Third-Party Services
The Service may rely on, integrate with, or link to third-party providers, including hosting providers, authentication providers, storage providers, analytics tools, crash or diagnostic tools, subscription management tools, app stores, payment systems, advertising networks, operating system functions, photo libraries, external browsers, and sharing features.
Your use of or interaction with third-party services may be governed by their own terms, policies, and privacy practices. We are not responsible for third-party services, content, policies, acts, or omissions.
These Terms are between you and us only, and not with Apple Inc., Google LLC, or their affiliates. However, Apple and its subsidiaries may be third-party beneficiaries of these Terms if you obtained the Service through the Apple App Store, to the extent required by Apple’s applicable terms.
20. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information in connection with the Service: Privacy Policy.
By using the Service, you acknowledge that you have read and understood our Privacy Policy.
21. Service Availability, Changes, and Data Preservation
We may modify, update, suspend, discontinue, or limit any part of the Service at any time, with or without notice, except where prohibited by applicable law.
We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, compatible with every device or operating system, or free from data loss, defects, delays, or harmful components.
We do not guarantee that User Content, account data, profile data, favorites, biographies, images, charts, or other data will always be backed up, recoverable, preserved, or available. You are responsible for maintaining separate copies of content that is important to you where appropriate.
22. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, or data preservation.
We do not guarantee that content on the Service will be accurate, complete, lawful, appropriate, available, or suitable for your purposes. User Content is created by users, not by us, and we are not responsible for User Content except to the extent required by applicable law.
We do not guarantee that using the Service will improve your profile, reputation, social relationships, creativity, self-expression, storytelling, personal insight, opportunities, work, education, business, or any other outcome.
23. Limitation of Liability
To the maximum extent permitted by applicable law:
- we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, content, opportunity, reputation, or other intangible losses arising out of or related to your use of, or inability to use, the Service;
- we will not be liable for User Content, third-party content, third-party services, unauthorized access, loss of data, moderation decisions, account restrictions, service interruptions, or platform billing issues, except to the extent required by applicable law;
- our total liability for claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to us for the Service during the twelve (12) months before the event giving rise to the claim; or (b) USD 50.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such cases, the above exclusions and limitations apply only to the extent permitted by the laws of your jurisdiction.
24. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless us, our affiliates, service providers, licensors, and personnel from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your User Content, your misuse of the Service, your violation of these Terms, your violation of applicable law, or your violation of any rights of another person or entity.
25. Governing Law and Jurisdiction
Unless otherwise required by applicable law, these Terms are governed by the laws of Japan, without regard to conflict of law principles.
Any disputes arising out of or in connection with the Service or these Terms shall be subject to the non-exclusive jurisdiction of the courts of Japan, unless the law of your country or region of residence requires otherwise.
26. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
27. Changes to These Terms
We may update these Terms from time to time. When we do so, we will update the “Last updated” date at the top of this document. If we make material changes, we may provide notice through the Service, website, or other reasonable means.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
